Children's Mother Addresses the Court before Judge Charles E. Wilson rendered his sentence
Good afternoon Judge Wilson:
Thank you for allowing me to be a voice for the deceased victim, Roberto Rivera, the father of my two children. Nothing and no one on the face of this earth can bring the right justice to Roberto and his family because no one can bring Roberto back to life. A precious life that is a miracle from God is not to be robbed away by another human being, like this defendant did to Roberto.
Since the killing of Roberto on May 4th of this year, my family has been shaken to the core. We are scared, confused and feel so much pain. The shock of hearing the news that Roberto is dead impacted us emotionally, physically and financially. Life is not the same anymore and can never be as normal and pleasant for my children without their father alive.
The killer being sentenced in court today, not just took one life, but took a part of a life from several other people that knew and loved Roberto. The killer impacted an entire city of Los Altos that lived free of murder for 26 years. Until yesterday, I didn’t know there was another man working with Roberto at the scene of the crime and he witnessed the violent act. What a nightmare he must be going through? The owner of the house that Roberto was working at and where he was killed was at home with his children. That is scary. No one deserves to have to live in fear. Life is too short and to be cut violently or be exposed to such senseless violence. It’s so wrong and unacceptable how this defendant gave himself the permission to violate so many innocent people and even recruit his younger brother, a juvenile, to help him carry out the murder. This incident and the careful planning of is beyond horrific.
I’m making this statement when I’m nervous and wish I didn’t have to be involved in this process, but I feel an obligation to stand up for Roberto’s life because it means a lot and specifically for my two children that have been deprived of having a father, one of the closest person who they trusted and depended on to grow older with and share life’s happy and sad moments with. Roberto was an active, loving and supportive father to our children, even though he and I were separated, but he always did right by his children (emotionally and financially.) My children and I are devastated since Roberto’s life was wrongly and without any remorse taken by the defendant. Even after this man killed Roberto and days later, he disparaged his innocent victim………it’s just unbelievable and so disturbing when he never even met Roberto.
I am making a statement for court today, in addition to talking to the Probation Officer to make sure and in hopes that the heaviest punishment is given this defendant, so he never gets an opportunity to hurt another human being. This man in front of you in court is very dangerous and disturbed. The only way to insure innocent people’s safety is to sentence him to life in prison.
Thank you Judge Wilson. I also want to thank everyone who supported me to understand what happened, why it happened and how to deal with it one step at a time. For everyone who was involved in bringing justice to Roberto and his family, I want to say “Thank You.” We don’t wish this pain on anyone and hope there are ways to be found, to prevent such senseless crimes from happening in the first place. We don’t wish this pain on anyone.

Roberto was senselessly shot to death on May 4th, 2020, his first day back at his masonry work project, in Los Altos, CA. Police investigation revealed the suspect was a jealous boyfriend of Roberto's Ex-Girlfriend. Roberto had never even met the killer. The facts of this case are very disturbing.
Please imagine the emotional trauma and the pain that Roberto's family and friends are left with. Murder in your community is everyone's business, it's not a private matter.
Roberto was a responsible father who spent time with his two children and helped their mother in raising them. The impact of such violence lasts a life-time. There will never be a dinner with dad on Father's Day. Roberto doesn't get to experience walking his daughter down the isle on her wedding day, nor will his daughter plan for such a memorable event. This family didn't ask for this pain, no victim does.
MAM is actively working with Roberto's family. We are the authorized advocates for his children through their mother and legal guardian. Financial support is important and a necessary service to ease some of the financial burden suffered by this family as a direct result of this violent act on a innocent man.

Mothers Against Murder “MAM”, Peninsula Victim Advocacy Community Based Organization, Secures Landmark Victory for Crime Victims’ Rights in California Superior Court
In a monumental win for victims’ rights, Mothers Against Murder (MAM) has successfully challenged the California Victim Compensation Board (CalVCB) in court, ensuring that crime victims are afforded the due process they have long been denied. The Alameda County Superior Court Judge ruled in favor of MAM, granting a Writ of Mandate that restores in-person hearings for victims contesting denied compensation claims.
For the past 15 years since 2009, thousands of crime victims in California have been denied fair hearings, forced to rely solely on written records that failed to capture their full experiences. This systemic injustice often resulted in wrongful denials of compensation, leaving victims without critical financial and emotional support. MAM’s lawsuit successfully exposed how CalVCB’s regulations had unlawfully stripped victims of their right to an evidentiary hearing, violating California law. The court’s ruling invalidates the California Code of Regulations Title 2, Section 647.20.1, which had improperly restricted victims to hearings based only on written records in file.
“This ruling is a lifeline for thousands of victims who have been silenced by an unfair system,” said Margaret Petros, the Executive Director and the expert Victim Advocate at MAM, and whose persistence proved CalVCB has been doing it wrong all along!! “Survivors deserve the dignity of being heard, not dismissed through paperwork. With this decision, justice has been restored.”
The decision mandates that CalVCB immediately cease its unlawful practices and provide victims the option of an in-person hearing when contesting compensation denials. This victory will impact thousands of victims across California who will no longer be denied due process, ensuring that no victim is ever ignored again.
MAM extends its deep gratitude to The Honorable Judge Frank Roesch of Alameda County Superior Court for recognizing the fundamental rights of crime victims and issuing a ruling that upholds justice and fairness.
In a final and decisive conclusion to this case, The Honorable Judge Sarah Sandford-Smith of Alameda County Superior Court ruled that MAM is entitled to attorney’s fees and costs, awarding $96,920.32 to the organization. This ruling recognizes the significant public benefit of MAM’s fight and reinforces the importance of holding state agencies accountable when they violate victims’ rights.
Mothers Against Murder expresses deep gratitude to the Honorable Judge Sarah Sandford-Smith for recognizing the importance of this case and ensuring that justice is served—not only for MAM but for all crime victims in California and for the attorneys who stand up for crime victims’ rights in CA Courts.
